Adaptations to the LOPD - LSSICE

Adaptation to the LOPD:

The security that is required under Spanish law. This application is designed for compliance with the LOPD (Ley Orgánica de Protección de Datos, Spanish Data Protection Act) and the LSSICE (Ley de la Sociedad de Información y Comercio Electrónico, Spanish Information Society and Electronic Commerce Act).

These provisions apply to any company or self-employed person who works with personal data, whether of employees, clients, suppliers or potential clients. They are therefore obliged to carry out this adaptation, which requires:

• That the company applies the security measures required by law in its entire organisation, and particularly in the IT department. These measures affect everything from backup copies to the manner in which the data is collected.
• That the company keeps a Security Document at the disposal of the Data Protection Agency inspectors. This document will be updated whenever necessary and will define the security measures taken by the company for this adaptation, the company's contract and notification forms, and the list of persons who have access to certain areas of data.
• That the company includes the corresponding notices in the documents which are used to collect personal data.
• That the company has in place the necessary procedures to enable any person to exercise their rights, as established by law, regarding the personal data stored.
• That the measures adopted to comply with this law are transmitted to the whole organisation.

Adaptation to the LSSICE:

This law is applicable to corporate websites that carry out e-commerce or describe products or services.

Each page of the website must contain an accessible legal notice, which must also be placed on every form in which personal data is requested and in every promotional e-mail sent by the company.
